In EVERY case, the judge MUST order the DUI offender to apply for an ignition interlock license, and have a working ignition interlock device installed for at least one year, but longer if there has been a previous ignition interlock requirement from a prior DUI conviction or deferred prosecution.

An ignition interlock device is a small device that is similar to a Breathalyzer test. Typically installed in the vehicle’s dashboard, the device measures your breath alcohol contentration (BAC).  If your BAC is over .025, you will be unable to start your vehicle.

The ignition interlock device is designed to withstand tampering. If you try to circumvent the device, your vehicle will not start and the incident will be recorded on the machine’s database. Some devices will even require you to hum into the mouthpiece in order to prove that you are not using an air machine.

You may also be required to take a rolling retest. This test, which occurs after the initial test, is used to ensure that you did not have a friend blow into the device to start the vehicle or begin drinking after driving. If you fail this test, the vehicle’s horn may honk and lights may flash until you pull over and turn off the ignition.

If ordered to have an ignition interlock device installed, you will be responsible for the associated expenses. There may be an installation charge, and the monthly rental fee can range from $70-$100. You may also have to pay for maintenance and repair fees.
